What is Collaborative Law?

Collaborative Law is a structured, out-of-court process where both parties commit to resolving their family law matter respectfully, with the support of specially trained solicitors. Each party has their own collaboratively trained solicitor, and everyone, including the parties, signs an agreement to work towards resolution without going to court.

The process is designed to reduce conflict, lower costs compared to court proceedings, and produce outcomes that genuinely reflect the needs and interests of both parties and any children involved. If the collaborative process breaks down, both solicitors must withdraw, and the parties would need to seek new representation for court proceedings. This incentivises everyone to work towards an agreement.

Flexible Funding Options for Your Family Law Matter
We understand that the cost of legal advice can be a significant concern when facing family law proceedings. Southern Waters Legal has partnered with JustFund to give eligible clients access to a legal fee funding facility for matters involving a property settlement.

How long does a property settlement take?

Property settlements vary significantly depending on the complexity of the assets involved and whether the parties can reach an agreement. A negotiated settlement can be finalised relatively quickly, while contested matters that proceed to court can take considerably longer. We work to resolve property matters as efficiently as possible for our clients.

Do I need to go to court for parenting arrangements?

Not necessarily. Many parenting arrangements are reached through negotiation, collaborative processes, or mediation without the need for court proceedings. Where parents cannot reach agreement and there are no safety concerns, family dispute resolution (mediation) is generally required before an application can be made to the Federal Circuit and Family Court of Australia. Our team can guide you through the most appropriate process for your situation.

What is a Binding Financial Agreement and is it enforceable?

A Binding Financial Agreement (BFA) is a legal document that sets out how property and financial resources will be divided between parties. To be enforceable, a BFA must meet strict requirements under the Family Law Act 1975 (Cth), including that both parties receive independent legal advice before signing. A BFA can be set aside by a court in certain circumstances, which is why it is essential to obtain proper legal advice before entering into one.

What does an Accredited Specialist in Family Law mean?

Accredited Specialist status in Family Law is awarded by the Law Society of NSW to solicitors who demonstrate an advanced level of knowledge, skill and experience in that area of law.
