Executor Duties

Being appointed as an executor is one of the most important and legally significant responsibilities a person can hold. You are personally responsible for identifying and protecting estate assets, notifying beneficiaries, paying debts, and distributing the estate in accordance with the Will. We guide executors through every obligation under the Succession Act 2006 (NSW), helping ensure they act with the authority, care, and compliance required.

Application for Probate

Probate is the formal legal process by which the Supreme Court of NSW recognises a Will as valid and authorises the executor to administer the estate. It is required before most financial institutions will release the deceased’s assets. Letters of Administration

When a person dies without a valid Will, known as dying intestate, there is no appointed executor, and no one has automatic authority to deal with the estate. Do I need probate for every estate?

Not always. Whether probate is required depends on the nature and value of the assets in the estate. Some assets, such as jointly owned property, superannuation, and small bank accounts, may transfer without probate. However, most financial institutions require a grant of probate before releasing funds. We assess your circumstances and advise on whether probate is necessary for your specific situation.

How long does probate take in NSW?

Once all documents are prepared and lodged with the Supreme Court of NSW, a standard probate application typically takes 4 to 8 weeks to be granted, provided there are no complications or objections. The overall administration of an estate, from lodging the application through to final distribution, can take several months to over a year, depending on the complexity of the assets, any outstanding debts, and whether disputes arise.

What are an executor’s responsibilities?

An executor is legally responsible for: locating and securing all estate assets; notifying beneficiaries and relevant institutions; applying for probate; paying outstanding debts, taxes, and liabilities; managing estate assets during the administration period; and distributing the net estate to beneficiaries in accordance with the Will. Executors can be held personally liable for errors. Our team provides full support to ensure you fulfil your obligations correctly.

What happens if someone dies without a Will in NSW?

Dying without a valid Will is called dying intestate. The estate is then distributed according to a fixed formula under the Succession Act 2006 (NSW), which may not reflect the deceased’s wishes. An eligible person, usually the spouse or next of kin, must apply to the Supreme Court for Letters of Administration before they can deal with the estate. We assist families through this process.

Can a Will be contested during probate?

Yes. Probate can be contested by a person who believes the Will is invalid due to lack of testamentary capacity, undue influence, fraud, or improper execution. A separate but related process allows eligible family members and dependants to make a family provision claim if they believe they were inadequately provided for.
