When should I engage a conveyancer — before or after I sign?

Ideally, before you sign. If you are buying a property, we recommend having your contract reviewed before you exchange, whether at auction or by private treaty. A pre-purchase contract review allows us to identify any conditions, restrictions or title issues that may affect your decision or your ability to proceed. Once you have exchanged contracts, the transaction is legally binding and your options are more limited.

How does electronic settlement work?

Most property transactions in NSW are now settled electronically through PEXA, Australia’s national electronic conveyancing platform. On settlement day, all parties, including the buyer’s solicitor, the seller’s solicitor, and the relevant financial institutions, log in to PEXA and the funds and transfer documents are processed simultaneously. Settlement is instantaneous, and you do not need to be present at a physical settlement. We will advise you of the scheduled settlement time and confirm once settlement is complete.

What is included in a conveyancing transaction?

A typical conveyancing matter involves: reviewing or preparing the contract of sale; arranging and reviewing property searches (title, council, water and other relevant searches); advising on any conditions, encumbrances or easements that affect the property; liaising with your bank or financial institution; attending to the exchange of contracts; and managing settlement through to registration of the transfer. We keep you informed throughout each stage.
